Terms of Service
This Photography and Media Services Agreement (“Agreement”) is entered into by and between Anthony Flores, doing business as Ridge & Pillar Studios (“Photographer”), and the Client.
1. Scope of Services
Photographer agrees to provide real estate photography and media services including:
- Interior and exterior real estate photography
- Professionally edited, MLS-ready images
- Drone photography where legally permitted
- Twilight photography
- Virtual tours
- Video walkthroughs
- Branding or promotional video recording
- Rush delivery services, if selected
All services, deliverables, and pricing are defined in the invoice issued by Photographer.
2. Creative Discretion
Client acknowledges that photography and media services are creative in nature and that Photographer is hired for their professional judgment, experience, and visual style. Photographer retains creative discretion regarding composition, editing, lighting, color, and final image selection.
Results may vary due to property condition, weather, lighting, or other factors beyond Photographer’s control.
3. Image Editing and AI Disclosure
Photographer provides standard image editing including exposure correction, color balancing, cropping, and lens correction.
Additional services such as virtual staging, object removal, sky replacement, or AI-assisted modifications are considered digitally altered images.
In accordance with California law (AB 723), altered or AI-modified images may require disclosure when used in marketing or listings.
Client is solely responsible for compliance with MLS rules and legal disclosure requirements.
Photographer will provide original images upon request.
Client accepts full responsibility for use of images and agrees to hold Photographer harmless from claims or misuse.
4. Retainer, Fees, and Invoicing
A non-refundable retainer of $100 is required to reserve the scheduled service date. The remaining balance is due upon delivery.
All pricing and services are defined in the invoice. The most recent invoice shall be considered binding.
5. Turnaround Time and Delivery
Standard delivery is typically 24–48 business hours. Additional services may require extended timelines.
Delivery may be affected by weather or unforeseen circumstances.
6. Client Responsibilities
Client must ensure the property is clean, staged, and ready. Photographer is not responsible for issues caused by unprepared properties.
7. Scope Changes and Additional Services
Any additional services beyond the original agreement must be approved in writing and may incur additional fees.
8. Revisions Policy
One reasonable round of revisions is included. Additional revisions may incur fees.
9. Copyright and Usage Rights
Photographer retains full copyright ownership of all media.
Client receives a limited license for marketing the specific property only.
10. Portfolio and Promotional Use
Photographer may use images for portfolio and marketing unless requested otherwise in writing.
11. No Guarantee of Sale or Performance
Photographer does not guarantee sale results, buyer interest, or performance.
12. Drone Services
Drone services are subject to weather, airspace restrictions, and safety conditions.
13. Equipment Failure and Delays
Photographer is not liable for delays caused by equipment issues, illness, or unforeseen events.
14. Property Condition and Liability
Photographer is not responsible for property damage or malfunctioning features.
15. Force Majeure
Neither party is liable for events beyond reasonable control.
16. Confidentiality
Both parties agree to maintain confidentiality.
17. Limitation of Liability and Indemnification
Liability is limited to the total amount paid. Client agrees to indemnify Photographer.
18. Assignment
Photographer may transfer this Agreement to a future business entity.
19. Electronic Signatures
Electronic signatures are valid and binding.
20. Severability
If any provision is invalid, the remainder remains enforceable.
21. Governing Law
This Agreement is governed by California law.
22. Entire Agreement
This Agreement constitutes the entire understanding between parties.
